Introduction

Profility Inc. (“Profility”, “we”, “our” or “us”) provides technology that enables personalized care planning, by optimizing decisions and transitions within a healthcare ecosystem and leveraging existing knowledge about how patients will respond to a particular treatment or pathway. (the “Services”). As part of the Services, we will be required to process various types of information, including information that may lead to the identification of a specific individual ("Personal Data").

In connection with the use of the Services and the processing of Personal Data, your healthcare provider ("Customer") is the entity which determines the purpose and means of processing of Personal Data under applicable privacy laws and we act only in accordance with its documented instructions with regards to the processing of patients’ ("End Users, you") Personal Data. This Privacy Notice ("Notice") was designed to help you understand these practices, including the scope of the information we process as part of our Services.

  1. What types of data we collect and process?

In order to provide our Customers and End Users with our Services, and in order to ensure our compliance with applicable laws we may collect and process the following data:

  • Name;
  • Medical Records Number;
  • Age;
  • Gender;
  • Medical information (diseases/ comorbidities, functional evaluation, behavioral evaluation, treatments);
  1. With whom we share your data?
    • Service providers. We may share your Personal Data with our trusted service providers. Such sharing will always be approved by our Customers and will be subject to applicable data protection agreements.
    • Law enforcement entities. We may also share Personal Data if required in order to comply with legal requirements.

Various jurisdictions provide you with certain statutory rights to your Personal Data. You may have the right to certain actions to your Personal Data, such as: confirmation as to whether or not Personal Data concerning you is being processed, access to your Personal Data, receiving a copy of your Personal Data, rectification of your Personal Data, erasure of your Personal Data, and objecting to the processing of your personal data or restricting it.

End Users may exercise their respective rights by contacting their healthcare provider in accordance with their privacy policy. You are also welcome to contact us for any questions or requests through the following email address: admin@profility.com, and we will assist our Customer in responding to your request.

  1. How we protect your data?

We have implemented administrative, technical, and physical safeguards to help prevent unauthorized access, use, or disclosure of your Personal Data. These safeguards are aligned with our contractual obligations to our Customers. While we seek to protect your information to ensure that it is kept confidential, we cannot guarantee the security of any information. You should be aware that there is always some risk involved in transmitting information over the internet and that there is also some risk that others could find a way to thwart our security systems. Please note that we are not responsible for our Customers' handling or protection of your Personal Data.

  1. Retention

We will retain your Personal Data for as long as necessary to provide our Services in accordance with the our agreements with our Customers, and as necessary to comply with our legal obligations or resolve disputes.
